Representing interests of Sberbank of Russia for recovery of multimillion USD loan
Our lawyers have successfully defended interests of Sberbank of Russia in recovery of the loan amount of USD 150,000,000 furnished to a construction holding for building of the complex “Tsarev Sad” in the center of Moscow.During realization of this project the lawyers of the Group “Yakovlev & Partners”:
• have recovered the loan ahead of the scheduled time, the debtor’s property was attached, a recourse was taken upon the debtor’s pledged securities (shares);
• have proved nullity of the deals on alienation of the construction object, which was built for the bank’s money;
• have protected the debtor’s assets and the bank’s interests in the bankruptcy proceeding, have prevented the unfriendly acquisition of the debtor by a group of companies. The lawyers also revealed the features of premeditated bankruptcy in the actions of the debtor’s manager;
• Presidium of the Superior Arbitrazh (Commercial) Court of the Russian Federation has recognized the debtor’s bill liabilities to offshore companies void and infringing the bank’s rights, therefore the offshore companies’ claims had been excluded from the register of creditors’ claims.
As a result of our lawyers’ efforts the bank’s claims have been fully satisfied, and the completed construction object passed under the bank’s control.
