Civil wives will receive payments for dead soldiers?

The cohabitants of the soldiers who died in their service or went missing will be able to confirm the fact of being in a civil marriage in a special procedure and receive state payments. Such a bill was submitted to the State Duma in order to "protect the interests of 'de facto' families." The document says that the courts can confirm a marriage if the common—law spouses have lived together for at least three years - or at least a year, but with a common child.


According to the decree of the President of the Russian Federation, families of servicemen killed in Ukraine, employees of the FSB, Rosgvardiya and the Ministry of Emergency Situations, volunteers and civil servants are paid 5 million rubles each, and families of the wounded — 3 million rubles. The government must pay 22.9 thousand rubles a month to the family of a deceased serviceman. (equal to the amount of disability payment for group I, established due to a military injury). It should be noted that in December 2023, Vladimir Putin proposed to think about "supporting those women who lived in a civil marriage with their husbands." The President said at the time that there were ways provided by law to establish the fact of living in such a union, mentioning common children in civil marriages. In January 2024, Vladimir Putin instructed the government of the Russian Federation to develop separate support measures for the civilian wives of the deceased participants in their military operations.

 
The bill submitted to the State Duma mentions the procedure for special proceedings, in which cases of establishing the fact of marriage are proposed to be considered by the courts.


It should be noted that the Civil Procedure Code of the Russian Federation has subsection VI on such proceedings, and chapter 28 of the CPC is devoted to establishing facts of legal significance (it describes the procedure for filing and content of applications in such cases).
